THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE
RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND
INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND
EXPEDITED EVICTION OF TENANTS. BY CHECKING THE ACCEPTANCE BOX BELOW, OR PAYMENT OF MONEY
OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF
YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION
RENTAL.

NIGHTLY MINIMUMS :

Please note that there is a 2-night minimum at all times, except during the peak season and on holidays, when we have a 3-night minimum. Please contact us for details!

DAMAGE / RESERVATION DEPOSIT :

A damage/reservation deposit is required. This must be received within two (2) days of booking the reservation. The reservation deposit automatically converts to a security/damage deposit upon arrival.
Deposits are held in a trust account at First Citizen Bank, Mills River, NC in the name of Gomountains, LLC. The trust account is a non-interest bearing account. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.

a. No damage is done to cabin or its contents, beyond normal wear and tear.

b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.

c. All debris, rubbish and discards are placed in refuse containers outside, and soiled dishes are placed in the sink and cleaned. One load of laundry is started.

d. All keys are left in the lock box and cabin is left locked.

e. All charges accrued during the stay are paid prior to departure.

PAYMENT :

Reservations are secured with a credit card at time of reservation. 100% of the rental fee and taxes will be due within a week of making the reservation.
All Payments made by the Guest shall be deposited in an escrow account with Gomountains, LLC. In accordance with North Carolina law, disclosure is hereby given that the agent escrow account is not interest bearing.
Reservations CANNOT be transferred to another person. Party paying for the reservation must be one of the guests staying in the rental.

CLEANING FEE :

A Cleaning Fee of $35 will be added.

OTHER CHARGES AND FEES :

A Fee of $35 will be charged for all returned checks.

RATE CHANGES :

Rates subject to change without notice.

TAX :

All reservations incur NC Sales Tax.

CANCELLATIONS AND CHANGES :

Cancellations made at least 31 days prior to arrival will be refunded the deposit minus a $50 Cancellation Fee.
All changes made by guest at least 31 days prior to arrival will incur a $10 Change Fee. The full amount is non-refundable for cancellations made within 31 days of arrival, unless we are able to re-rent the property for the same time period or any portion of dates as your original reservation.
A home that is unacceptable to the guest is considered a cancellation. Guests are responsible for all nights reserved regardless of late arrival or early departure.

STORM POLICY / ROAD CONDITIONS :

Gomountains, LLC is not responsible for the weather or other Acts of God and there will be no refunds for damages resulting from said events.
No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained, however we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions.

PET POLICY :

No pets allowed.

SMOKING :

Smoking inside the rental home is PROHIBITED. Smoking is permitted in all outside areas. Ashtrays are provided on the deck. Do not discard butts on the grounds or in the creek.

OCCUPANCY :

The maximum number of guests per cabin is limited to six (6) persons, unless otherwise approved in writing in advance by Gomountains, LLC. An additional charge or $10.00 per person per night for guests in addition to six (6) will be assessed. Maximum Occupancy Violations will result in rent forfeiture and immediate eviction of guests.
Absolutely no house parties, youth groups, fraternities, sororities, weddings, receptions, meetings, or parties allowed. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. If such a person or group attempts to occupy the rental property, all monies will be forfeited and guests will be asked to vacate the property immediately.

FALSIFIED RESERVATIONS :

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

HOT TUB :

No children under the age of 12 permitted in hot tub at any time. When using the hot tub, remember there is certain health risk associated with this facility. Use at your own risk. Hot Tub Safety Precautions are posted in the cabin. It is assumed that you will read and abide by those precautions. Women who are pregnant should not use the hot tub.  
Tenant hereby acknowledges that the undersigned is fully aware that the hot tub and surrounding deck can be dangerous, that the deck can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Getting into and out of the hot tub should be done in a safe manner and tenant should use great care near the deck rails. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the hot tub and deck areas.
Hot tub covers are for insulation purposes and are not designed to support a person or persons. DO NOT STAND ON THE HOT TUB COVERS, they will break and you may be charged for replacement.
Remember when not using the hot tub, leave cover on so hot tub will stay warm.

NO SOAPS OR LOTIONS OF ANY KIND ARE TO BE USED IN THE HOT TUB !

MECHANICAL FAILURES AND REPAIRS :

Gomountains does routine inspections to make sure all appliances and amenities are functioning properly. In the event of mechanical failures such as, but not limited to, Hot Tubs, Air Conditioning, Jacuzzis, or any other appliance that fails to operate properly during your stay, Gomountians will not be held responsible. These failures are beyond our control and no refund or rent reduction will be given.
Please report inoperative equipment to Gomountains. Hosts will make every effort to have repairs done as quickly as possible during reasonable hours.

WHAT TO BRING :

Every rental is equipped with linens, towels, cooking utensils (coffee maker as well), and some cleaning implements. Unless specified, other amenities are not provided. Each rental is equipped with a smoke detector for you protection. Please check it upon arrival to ensure your safety (sometimes batteries die and go unnoticed). Please contact the Host immediately if the detector is not working.

CLEANING :

Gomountains Cabin is professionally cleaned before you arrive and after you leave. Please report within 4 hours anything we fail to clean. Guests are responsible for cleaning and storing all dishes, utensils, and removing all trash to the appropriate outside container. Failure to do so will result in additional charges.

NO DAILY MAID SERVICE – While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate however is available at an additional rate. We do not permit towels or linens to be taken from the cabin.

PERSONAL ITEMS :

Gomoutaians, LLC is not responsible for Guest's personal belongings that are lost, stolen, or left behind.
A $20 Retrieval Fee will be charged, and if found, the items will be returned at the Guests' expense.

CHECK-IN AND CHECK-OUT :

CHECK-IN IS AFTER 4PM. 
Check-in before 2PM, if property is available, incurs a $20 Fee plus sales tax.

CHECK-OUT IS AT 11AM. 
If the property is not vacated at 11AM, Gomountains is authorized to remove
your belongings from the property.

ACCIDENTS :

Guest agrees to hold Gomountains harmless for any accident or injury whatsoever that may occur on the rental property during occupancy, except to the extent that such injury or accident is caused by the gross negligence of Gomountains, its agents and/or assigns.
The cabin is privately owned; the owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
